What is the difference between ordinary deletion and data destruction?
Logical deletion (delete, format, factory reset) generally only removes references to the data, leaving the content potentially recoverable with forensic tools. Destruction (sanitization) ensures the data can never be recovered — through degaussing for magnetic media or physical destruction of the media itself. The PDP Law treats erasure and destruction as distinct obligations for data controllers.
When is degaussing used, and when is physical destruction required?
Degaussing eliminates data on magnetic media such as hard drives and tape by destroying their magnetic patterns, rendering the media unusable. For SSDs and flash storage, degaussing is ineffective because the data is not stored magnetically — these media must be physically destroyed or sanitized by another appropriate method.
